TEMPUR-ActiveBreeze® Water Resistant Mattress Cover Limited Warranty

Your TEMPUR-ActiveBreeze® Water Resistant Mattress Cover will be replaced or repaired at our option, without cost to you, if it is defective due to faulty workmanship or materials, such as material pilling or stitching failure, for one (1) year from date of purchase, subject to the limitations described in this warranty.

This warranty does not cover or apply to:

• Normal wear and tear, normal everyday soiling, or commercial use
• Covers that are misused, abused or not handled per laundering instructions, or that are commercially laundered or dry cleaned
• Your linens, foundation, box spring, or mattress
• Damage caused by using the product in any manner that is inconsistent with applicable owner’s guides, user manuals, or other operational instructions, or from damage caused by misuse or abuse, including but not limited to stains, soil, burns, cuts, tears, or spills or factors other than a product defect, are excluded hereunder and will void this warranty.
• This warranty does not provide coverage and will become void if damage is caused by acts of nature including but not limited to fire, flood, or lightning damage or for damage caused by power surges.

To the extent that any of these exclusions are not permitted under the laws of your state, that particular exclusion does not apply to you.

To process your claim, you must:

1. Confirm that proper laundering and care instructions have been followed.
2. Machine-wash and dry the mattress cover immediately after any spillage incident, optimally while fluid is still wet.
3. Register a claim within 5 days of an incident.
4. Return the product for inspection and validation as instructed. Shipping and handling fees are your responsibility.
5. Provide proof of purchase for your cover.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

We are not liable for any consequential, special, indirect, or punitive or exemplary damages of whatever kind and are only required to service a faulty product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Please retain this warranty and original proof of purchase for 1 year from date of purchase.
